PURPOSE: To be able to comply with or respond appropriately to your request.

LEGITIMACY OF DATA PROCESSING

Exercise of the powers attributed to the City Council by Law 7/1985, of 2 April, regulating the bases of the local regime, and by Law 39/2015, of 1 October, on the common administrative procedure of public administrations.

PERIOD FOR WHICH THE DATA WILL BE STORED

For as long as the purpose for which it was collected remains valid. The data will be stored for longer periods for archiving purposes in the public interest.

RIGHTS

● Right of access. To know what personal data about you is being processed, for what purpose, the origin of the data and whether it is being or has been communicated to third parties.
● Right of rectification. To obtain the rectification of inaccurate personal data concerning you.
● Right of erasure (‘the right to be forgotten’). To obtain the erasure of personal data that is not necessary, for which consent has been withdrawn, has been obtained unlawfully, and in other cases specified by the GDPR.
● Right to restriction of processing, while challenges are being resolved, expressly requested, and when the Alicante Municipal Tourism and Beaches Board does not need the personal data for the purposes of processing, but the data subject needs it for the formulation, exercise or defence of claims.
● Right to data portability. The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to the Alicante Municipal Tourist Board, in a structured, commonly used and machine-readable format, and to transmit those data to another controller.
RIGHT TO OBJECT

II. Purposes of Processing and Legal Basis

Personal data collected through the various channels on the website (contact forms, complaints box, booking requests or cookies) will be processed for the purposes detailed below. In each case, the legal basis for the processing is indicated, in compliance with Art. 6 of the GDPR.

III. Data Retention Periods or Criteria

In accordance with the principle of storage limitation (Art. 5.1.e GDPR), the Board of Trustees will retain your personal data for as long as necessary to fulfil the purposes for which it was collected:

Data for Administrative Services and Reservations They will be kept for a period of 5 years after the end of the service, in order to comply with possible legal, fiscal and administrative responsibilities (Law 39/2015).
Data kept due to Legal Obligation The data will be kept blocked for the legally established periods (limitation of liability) to deal with possible claims.

IV. Recipients of the Data

The Alicante Municipal Tourism and Beaches Board will not transfer your personal data to third parties, except in cases where it is strictly necessary for the provision of the service or where there is a legal obligation to do so:

  1. Public Authorities and Security Forces: When there is a legal obligation to communicate data.
  2. Data Processors: External providers that provide services to the Board (e.g. web hosting, technical support, email marketing platforms), acting under the instructions of the Board and after signing a Data Processing Agreement in accordance with Art. 28 of the GDPR.

V. Exercise of Rights (ARCOPD)

You have the right to exercise the following rights before the Alicante Municipal Tourism and Beaches Board, at no cost:

If you consider that you have not obtained satisfaction in the exercise of your rights, you may lodge a complaint with the Spanish Data Protection Agency (AEPD).

VI. Security and Confidentiality

The Board of Trustees guarantees the application of appropriate technical and organisational measures to ensure the security and confidentiality of your personal data, in order to prevent its alteration, loss, unauthorised processing or access, taking into account the state of the art, the nature of the data and the risks to which it is exposed (Art. 32 GDPR).

The Board of Trustees, as a body attached to Alicante City Council, assumes the obligation of confidentiality of personal information (Art. 5.1.f GDPR), this being an area of risk previously detected by the AEPD in the parent entity.
